General Conditions of Sale: The disposals that follow establish the general conditions of sale of the products proposed by the corporation on its site Web at the following Internet address: http://www.scarabee-bleu.com To accept the general conditions of sale means that one has read the conditions shown and that you have agreed to accept the present conditions. The Corporation ‘Le Scarabée Bleu’ invites you therefore to read carefully the clauses shown below. The Corporation ‘Le Scarabée Bleu’ informs you that it is not possible to buy a product without accepting these foreseen conditions below. ITEM 1 - Object The present contract determines the rights and obligations of the Corporation ‘Le Scarabée Bleu’ and customer in the framework of the sale of the products proposed by the Corporation ‘Le Scarabée Bleu’ on its website. ITEM 3 - Applicable Law The Parties accept that this contract is subjected to French Laws. ITEM 4 - Characteristic of the Products Offered The Corporation ‘Le Scarabée Bleu’ is to inform the customer of the essence of the essential characteristics of the products offered on its site www.scarabee-bleu.com. These characteristics appear in support of the photograph shown on the web site illustrating the offer. The customer recognizes that the photograph representing the product that figures on the website has only an indicative value. Differences are able in fact to appear owing to the treatment of the photo. The Corporation ‘Le Scarabée Bleu’ invites the customer to read attentively these characteristics. In a general manner, these characteristics concern, the weights, the quantities, and the components of the products offered. The Corporation ‘Le Scarabée Bleu’ limits geographically its offers so proposed to countries that have for their currency: the Euro. The customer is informed that the product will be delivered to them by way of Normal Post. ITEM 5 - Engagement When the customer clicks on the icon "orders ", it then is secured irrevocably; the acceptance cannot be questioned except by the application of the Item 9. ITEM 6 - Prices The prices are indicated in Euros. The price does not include the delivery expenses for countries other than France – for countries other than France there is an extra charge – this will be communicated to the customer with the confirmation mail. ITEM 7 - Order Confirmation The Corporation ‘Le Scarabée Bleu’ will confirm to the customer all orders by email. On this confirmation there will be the mention of the ordered product, its price, the payment method as well as its delivery methods and this will be communicated by email at the latest by time of the delivery. ITEM 8 - Proof These order confirmations will be archived within the corporation ‘Le Scarabée Bleu’ and will be considered as being worth proof of the nature of the convention and of its date. ITEM 9 - Delay of Retraction In accordance with the item L 121-16 of the Code of the Consumer, the customer has the right to a delay of retraction of 7 days from the date of receiving of the ordered product. In the hypothesis where the customer would not have received in the meantime the confirmation order, this delay of retraction may be extended up to 3 months. If the customer exercises his delay of retraction, the Corporation ‘Le Scarabée Bleu’ will involved itself to reimburse and this without expenses to the customer in a delay to a maximum of 30 days. The customer can equally choose to exchange the product. In case of retraction the merchandise must have returned in his original packing, all costs will be borne by the sender. ITEM 10 - Delivery The corporation ‘Le Scarabée Bleu’ is involved itself to book the ordered products under 30 days from the confirmation of the order. If the product is unavailable, the customer will be informed as soon as possible and will be able to cancel his order. The customer will then be able to ask for an exchange of the product or a reimbursement. The products are delivered to the address advised by the customer on the order voucher. The consumer must provide an address to which the delivery can be carried out during normal postal working hours. All complaints must be addressed to the advisable address as shown in item 1 above. The customer will verify the general aspect of the packing of the delivered product; in case of damage, the customer must indicate in writing to the carrier at the latest 12 hours after the delivery with copies by email or mail to the Corporation ‘Le Scarabée Bleu’. In case of non-accordance of the delivered product, the Corporation ‘Le Scarabée Bleu’ is involved itself to exchange the product or to reimburse the customer on simple request of this. ITEM 11 - Guarantee - Limitations The Corporation ‘Le Scarabée Bleu’ guarantees that all the products are in accordance with their description as shown on the web site to the date back to the order. No other guarantee express or tacit is granted. The Corporation ‘Le Scarabée Bleu’ could not know to guarantee that the products reply to the specific expectations of the customers. ITEM 12 - Payment For each product offered for sale, the customer will be held to pay by cheque. The ordered products remain the property of the corporation ‘Le Scarabée Bleu’ until the completion of the sale. ITEM 13 – Personal Information For the good sequence of the order, the so called collected data will be the object of a data processing, the customer therefore recognizes that they have knowledge of this. The information collected concerning it cannot be communicated to the commercial partners of the corporation. The customer disposes equally of any access rights and of rectification with regard to all information concerning it that is included in the files of the corporation. ITEM 15 - Regulation of the Litigation In the hypothesis where a litigation would be born of the present contractual relation, both parties are to involve themselves before all judicial action, to look for a solution by private agreement. The parties however agree that all born litigation of the present contract is within the exclusive competence of the jurisdictions of LILLE (FRANCE).
